Industrial Emissions Directive application success

Wiser Environment has received a 100% ‘duly made’ success rate on IED applications made for the September deadline.

The Environment Agency (EA) and Natural Resources Wales (NRW) are currently implementing the Industrial Emissions Directive (IED) through the amendment of the Environmental Permitting Regulations (EPR) 2013, which imposes new requirements on some installations and extends the scope of EPR installations to newly prescribed activities.

All new and existing installations will be assessed against Best Available Techniques (BAT) as guided by European guidance notes (BREFs) and associated BAT conclusions. The IED already applies to new installations permitted since 7th January 2013 and existing installations, operational on 7th January 2014. For existing facilities which are currently exempt or operational as a waste activity, which are to become installations as ‘newly prescribed activities’, the IED will apply from 7th July 2015.

Operators of ‘newly prescribed activities’ have been required to submit variation applications to become an installation. There are a number of activity specific deadlines by which operators must have submitted a ‘duly made’ application to the EA to make benefit of a statutory defence, if they then fail to receive a full installation permit by 7th July 2015.

Wiser Environment supported a number of operators during the process leading up to the first deadline (30thSeptember 2014), specific to operations – gasification of fuel other than coal, biological processing of chemical and waste recovery. Wiser prepared and submitted variation applications and supporting documentation prior to this deadline and received a 100% ‘duly made’ success rate prior to this deadline.

The next deadline (31st December 2014) is for operators of hazardous waste treatment, waste disposal and wood preservation facilities. If you are an operator of one of these types of facilities and would like to informally discuss your facility with us to determine whether you will become a ‘newly prescribed activity’ under the IED then please contact us either by telephone on 01480 462 232 or email:, and we will be happy to assist you.
